The government has taken a bold step to protect and conserve the environment by putting in place policy and legislative instruments through the National Environment Policy (1997) and the Environmental Management Act (EMA) (2004). The Act puts in place an administrative and institutional framework for environmental management that cuts across all levels of government administration that includes line ministries and local government authorities. EMA further outlines various environmental management tools such as Environmental Assessments, Environmental Standards and economic instruments. In addition the Act makes provision for the development and promulgation of regulations, guidelines and rules for effective implementation of the Act. Despite these efforts, there are still a number of challenges and gaps among responsible institutions and actors with regard to fully implementation of the EMA. These include among others, incompleteness or non-formulation of some of the regulations and guidelines, inadequate institutional capacity in sector ministries and local government authorities to implement the Act, and low awareness by the general public on their roles and responsibilities in implementing EMA. This therefore calls for a deliberate need to address the articulated challenges to foster effective implementation of the EMA. The proposed project aims at enhancing the national capacity for implementing the Environmental Management Act for sustainable environmental management in Tanzania. The project will facilitate development of regulations, guidelines and by-laws as well as other practical tools for sustainable utilization of natural resources. Furthermore, the proposed project will inculcate the culture of integrating enforcement of environmental laws in local development plan; and building capacity on the EIA/EA processes such as training EIA/EA experts and Technical Advisory Committee (TAC) members. The project will intervene in five key areas that further strengthen and enhance the implementation of EMA. These include conducting a study on the status of EMA implementation since its coming into force in 2005; preparation of the missing regulations guidelines and rules; support LGAs in the preparation of by-laws; building capacity in terms of training key EMA implementers at both central and local government levels; improving awareness and sensitization to the general public on their roles and responsibilities in implementing EMA along with the establishing of databases to improve public access to environmental information; and simplifying the application, processing and issuance of licenses and permits.

Result
The Vice President Office (VPO), in collaboration with the National Environment Management Council (NEMC), is implementing a three (3) years project on "Enhancing National Capacity for Implementation of the Environmental Management Act" with a total cost of 6.9 billion Tanzania Shillings (3 million USD) funds from Sweden Government. The objective of the project is to enhance the national capacity for implementing the Environmental Management Act Cap 191 for sustainable environmental management in Tanzania. Summary of the Results Achieved: Component 1: To enhance institutional and legal framework for effective environmental management Activities planned for implementation under this Component include undertaking comprehensive assessment of the implementation of the Environmental Management Act Cap 191 develop regulations, guidelines and an online legal database to support environmental management conduct training to regulatory authorities and support operationalization of the National Environmental Trust Fund and Environmental Appeals Tribunal. - Terms of Reference for the assessment study were developed, however, the study was yet to be undertaken during the reporting period due to delay in meeting procurement procedural requirements for recruiting a Consulting Firm in accordance with the Public Procurement Act and its Regulations. The delay in development of the Regulations and Guidelines was due to their dependence on input from the assessment study which is yet to be undertaken. - The development of online legal database was undertaken in April-June, 2022 - The National Environmental Trust Fund (NETF) and the Environmental Appeals Tribunal were not yet operational, awaiting administrative and legal interventions, which would have triggered project support in their operationalization. Component 2: To modernize environmental licensing and monitoring capacity Activities planned for implementation under this Component include upgrading licensing system for the Strategic Environmental Assessment (SEA) from manual to online platform and establishing database on waste management in the country. - The online SEA permit system was expected to be finalized by September,2022 - The development of waste management database was not undertaken as it was planned to be implemented in the 3rd and 4th Quarter of the Year 2021/2022 for which funds were yet to be requested since the first installment of project funds (meant for the 1st and 2nd Quarters) was yet to be fully expended. Component 4: To enhance the capacity of MDAs and LGAs for effective implementation of EMA Activities planned for implementation under this Component included empowering MDAs and LGAs in implementation of the Environmental Management Act through: development of National Waste Management Strategy and Activities Action Plan (NWMSAP) training of regulatory authorities and development of pilot Local Government Environmental Action Plans for Dodoma Capital City. - Terms of reference for developing the NWMSAP were prepared by April, 2022. The delay in the development of the Strategy was due to delay in meeting procurement procedural requirements. The development of NWMSAP was expected to start in September, 2020 - The training of regulatory authorities was supposed to be implemented in the 3rd and 4th Quarter for which funds are yet to be requested since the first installment of project funds for the 1st and 2nd Quarters was yet to be fully utilized. - The development of pilot Environmental Action Plan for Dodoma City was delayed awaiting completion of the National Environmental Master Plan for Strategic Interventions and Projects (2022-2032) which provides specific environmental management guidance for Dodoma Capital City, which would serve as an input in the development of the Action Plan. Component 5: To facilitate effective public communication and strategic engagement of key stakeholders Activities planned for implementation under this Component included enhancing public communication on environmental management through procurement of state-of-the art digital media equipment for VPO and NEMC and establishing National Environmental Stakeholders Forum for sharing experiences and recommending effective policy interventions. - Procurement of media equipment for VPO was completed in May, 2022 whereas procurement of the similar equipment for NEMC - was completed in July 2022. The list of media equipment procured is provided in Annex V of the attached annual progress report. Component 6: To ensure effective project management This Component intends to oversee and ensure effective implementation of project activities. Activities planned for implementation under this Component include organizing Inception Meeting meetings of the Project Steering Committee (PSC) and Technical Advisory Committee (TAC) procurement of office equipment for NEMC and VPO conduct annual financial audit of the project and undertake Monitoring and Evaluation of the Project. - The First Meeting of the Project Steering Committee was held on 21 September, 2021. - Procurement of office equipment for VPO and NEMC was completed between May, 2022 and July, 2022. - Annual financial audit was conducted and finalized by July, 2022. Generally, the implementation progress during the reporting period was slow. The activities that were not on good progress were planned to be accomplished in the following year of the project (2022/2023).
The intended outcome of the proposed development intervention be improved state of the environment in Tanzania, through effective coordination and implementation of the key environmental laws and guidelines across government at the central and local levels. In connection to the National environmental policy, Tanzania established a national environmental management Act in year 2004, which is supposed to act as an environmental law. But the implementation of the environmental laws has been inadequate in several aspects. There is a will from the government of Tanzania to implement the environmental laws. NEMC and VPO will gain experties and experiance in environmental protection and experience of public environmental work, as well as working with implementation of environmental politics. Further more NEMC as inforncement arm of the goverment will gain expertise efficient and effective environmental governance, based on democracy, human rights and rule of law. And create better conditions for good environmental governance and strengthen the capacity of LGAs, private sector and other institutions. The purpose of the project is to enhance the national capacity for implementing the Environmental Management Act, by strengthen the capacity of National Environmental Management Council (NEMC) in Tanzania. So that NEMC can address difficulties and work on the implementation of the environmental laws in Tanzania. The main focusing areas within the capacity building will be to increase the environmental impact assessment and public environmental work. The result of this project will contribute to improved management of natural resources in Tanzania. With support of Swedish Environment Protection Agency (SEPA), NEMC will assist in training environmental management act implementers, assist LGAs in the preparation of by-laws, improve awareness to the general public on their roles in implementing EMA and establish databases to improve access to environmental information in addition to simplify the application of licenses and permits. The SEPA participation also aims to build a long-term relationship with NEMC in Tanzania.
