Projektet är en fortsättning på stöd för förbättrad effektivitet inom HJPC. Resultaten av den tredje fasen är att förbättra domstolarnas effektivitet och även verkställigheten av domstolsärenden. Effekten av stödet är att ha ett domstolssystem som garanterar människor rätten till en rättvis rättegång inom rimlig tid. Detta är en förutsättning för anslutning till EU-medlemskap. Effekterna av projektet kommer också att bidra till att förbättra allmänhetens uppfattning om domstolssystem och också leda till en mer funktionell ekonomi.

Resultat
HJPC is reporting on the following results: In component 1, activities related to support to court presidents and court management in the 10 pilot courts completed, with a baseline established. 9 out of 10 court are fully on track to continue to next stage of implementing new business model. Sarajevo Municipal Court is the only problematic court thus far and this is due to the fact that despite being largest local court, it has few allocated resources (primarily trainees) to implement the new activities. HJPC has raised this with the Sarajevo Canton Ministry of Justice, and an improvement of the resources for this court is expected in 2022. Support to the pilot courts in their implementation of the Blueprint through three visits by Swedish sister court teams is provided as planned. Computers for trainees have been procured by HJPC and a working group established and started meeting on implementing the new model. In Component 2, a comprehensive overview of workload in all first instance courts in BiH was completed, with a particular focus on the number of pending cases and the number of judicial office holders, and based on that pilot courts were identified. Initial meetings with presidents of the target courts were organised. An optimum workload distribution plan for judges and court departments in the target courts was developed with input from the members of the HJPC Standing Committee for the Efficiency and Quality of the Courts. In cooperation with the presidents of pilot courts and members of the Standing Committee for the Efficiency and Quality of the Courts, a set of recommendations with good practices in achieving optimum utilisation of human resources prepared detailed analysis of the quality and actual effects of the application of the Book of Rules on Performance Measures in all courts in BiH. For Component 3, expert teams with BiH and Swedish judges and other experts on the BiH civil procedure are tasked with mapping and finding broad agreement on the major shortcomings of the current appeal process in BiH. A situation report is completed. Finding possible other legislative initiatives and similar processes that will have an influence on the matter and could create synergies identified is an ongoing activity. In Component 4, the Swedish Enforcement Authority conducted analysis on working processes of enforcement departments in pilot courts, this was completed. The Swedish experts provided technical support to the work of the working group on enforcement reform. Proposed amendments and recommendations made by the Working Group are ready to be submitted to the legislative and executive, pending resolution of the current political stalemate. Component 5a and 5b (split by who is implementing, HJPC or Swedish partners) is proceeding according to set plans. The reference group in charge of assisting judicial institutions in the implementation of the Strategy on Improving Gender Equality in the Judiciary of B&H (SIGE) established dialogue meetings. A step by step manual Pilot Phase Strategy Implementation Plan was developed by the Reference Group Activities in pilot judicial institutions (to test the activities at the pilot judicial institutions, test the templates and the guidelines, build experience and identify relevant and good examples, identify ambassadors from courts and prosecutors offices) Activities in pilot judicial institutions are carried out according to plans and continuous coordination with other relevant initiatives and projects in being taken to avoid duplications and to be able to disseminate results for a constructive dialogue gender equality in the judicial institutions, is an ongoing activity. In component 6, which is on cross cutting priorities (vulnerable citizens access to justice, the plans are being met. One activity is assessing the architectural accessibility of the judicial buildings to people with disabilities and is completed. Second is a focus on improved the data collection system on gender-based and domestic violence, hate crimes processing and the adjustments of HJPC data systems to reflect it are all on plan. In Component 7 which is about media communications, a baseline is set for each of the three pilot courts. HJPC also organized a roundtable-meeting with journalists, media editors, NGOs, management and staff in the pilot courts to perceive the situation and possible problems from the perspective of media.
The ICEA 3 programme has requested the Embassy of Sweden to support 9 components (projects). HJPC will be asked to remove components 7 and 9 of the programme in whole or in part before final decision on the programme. These components are highlighted in appraisal. 1. Enhanced conditions for a more efficient use of the court staffs particular knowledge and skills especially of non-judicial staff 2. Improved system for redistribution of cases among available judges in the court and more adequate application of the Book of Rules on Indicative Performance Measures for Judges and Legal Associates in Courts in BiH 3. Enhanced conditions for a reform on a more efficient appeal procedure for civil litigation in BiH 4. Enhanced conditions for a more efficient enforcement procedure in pilot courts in BiH. 5. Improved conditions for judicial institutions to plan and start implementing the Strategy for Improving Gender Equality in the Judiciary in BiH. 6. Improve the position of vulnerable groups in contact with the justice system 7. Improving energy efficiency, security and removing barriers for people with disabilities 8. Enhanced conditions for a continuous proactive and effective communication with the citizens via media 9. Module for Electronic Evidence Management (MEME) established in the BiH judiciary
