An earth rights defender is someone who, individually or collectively, promotes human and environmental rights, which includes rights to food and clean water and to a healthy and safe environment. The long-term goal of the program is that rights defenders have or are on the path to justice through the court system, advocacy and other methods. The partner works directly with rights defenders and their communities, through capacity building and networking, to ensure that they are equipped to stand up for their rights. Work with and for defenders often takes the form of precedent-setting transnational litigation, which also influences international bodies to adopt policies that protect defenders. Berörda lokalsamhällen, urfolksgrupper, individuella aktivister och organisationer, som ofta har en hotbild mot sig och i flera fall kriminaliserats, har på olika sätt stöttats i att försvara sina mänskliga rättigheter kopplade till mark och naturresurser. Detta omfattar exempelvis urfolks skydd av sina territorier mot illegal gruvdrift och skogsskövling. Skyddet av rättighetsförsvarare har stärkt deras kunskap om mänskliga rättigheter, lokala lagar, regler och processer för miljöskydd samt om den privata sektorns sociala och miljömässiga åtaganden. Organisationen har bistått med juridisk rådgivning och stöd i rättsprocesser vilket inkluderat att representera parter i mål som rör urfolksgrupper och rättighetsförsvarare. \n\nERI har även engagerat sig normativt för att påverka situationen för rättighetsförsvarare och deras lokalsamhällen. Exempelvis ökar organisationen medvetenheten om de olika fall man driver på sina digitala plattformar och mediekanaler som en del av arbetet med att uppmärksamma den kritiska situation som rättighetsförsvarare står inför.\n\nVidare har programmet kunnat föra samman miljöförsvarare från lokalsamhällen, exempelvis genom utbildning och nätverk som faciliterat erfarenhetsutbyte mellan Amazonasregionen och Demokratiska Republiken Kongo för att stärka kunskapen om exploatering av naturresurser och strategier som kan användas för att skydda rättigheter. Detta har även skett med miljöförsvarare från Mekongregionen.\n\nFöljande är specifika exempel på uppnådda resultat:\n- I Colombia säkrade ERI:s arbete en juridisk seger i den Inter-Amerikanska domstolen för mänskliga rättigheter (IACHR), som höll den colombianska staten ansvarig för att ha kränkt ursprungsbefolkningens (U'wa Nations) rättigheter. Beslutet utgör ett prejudikat för skyddet av kulturella, territoriella och miljömässiga rättigheter i hela Latinamerika.\n - Till förmån för urfolk i Colombia, Brasilien, Ecuador, Guatemala, Honduras och Peru säkerställde ERI etniska gruppers deltagande i en utfrågning inför den Interamerikanska domstolen om klimatkatastrofer och mänskliga rättigheter. Stöd gavs även inför och under utfrågningen.\n- I Honduras har ERI, efter många års arbete, kunnat ingå avtal med regeringen om att installera och bemanna en trepartskommission med kompetens att utreda brott mot människorättsförsvarare. ERI har även bistått parterna i ett mål mot staten rörande människorättskränkningar som resulterade i att den Interamerikanska kommissionen för de mänskliga rättigheterna ingav en ansökan till IACHR att ta upp fallet. Arbetet utfördes mot bakgrund av att sju markrättsförsvarare, inklusive individer som EarthRights stöttat, mördats i landet under kort tid. ERI har fortsatt dokumentera attacker mot rättighetsförsvarare, och lämna in rapporter och bevismaterial till IACHR.\n - I Peru har ERI stöttat organisationen FENAMAD i ett fall om skydd av isolerade befolkningsgruppers rättigheter i Peru, som lagts fram inför IACHR. Som resultat tog domstolen upp rättsfallet under 2023, och beaktade därvid ERI:s synpunkter kring kriminalisering, nya skogskoncessioner och vägar inom folkgruppernas territorium då den inlämnade informationsförfrågningar till den peruanska staten i frågan. Domstolen identifierade sedermera kränkningar av rättigheter och lämnade rekommendationer till staten. ERI har fortsatt att tillhandahålla rättsligt försvar och stöd till lokalsamhällsmedlemmar och rättighetsförsvarare som kriminaliserats. \n- ERI har också bistått med juridiskt stöd i ett rättsfall i landet som resulterade i att Perus Environmental Oversight Agency utdömde böter till förmån för en fiskeförening\nsom drabbats av ett oljeutsläpp.\n- ERI har representerat lantbrukare vid en rättsprocess mot Världsbankens International Finance Corporation (IFC), rörande skador orsakade av ett palmoljeföretag som IFC finansierat. År 2023 ledde denna process till förlikning mellan parterna.\n- Det globala påverkansarbetet har omfattat de nya standarder för multinationella företag (Guidelines for Multinational Enterprises on Responsible Business Conduct) antogs av OECD 2023. Under processen som ledde fram till uppdateringen förespråkade ERI ett förbättrat skydd för människorättsförsvarare. Dessutom tillhandahöll ERI omfattande input inför och granskning av helt nya riktlinjer för människorättsförsvarare i de Frivilliga principer om säkerhet för mänskliga rättigheter, som antogs av the Voluntary Principles Initiative under 2023.
